wills

Wills and Estates Law focuses on planning the distribution of an individual’s assets and managing the legal processes of estate administration. The administration of an estate can involve complex legal and procedural requirements. Where a valid will exists, the appointed Executor may apply for a Grant of Probate—providing the legal authority to collect, manage, and distribute your assets in accordance with your expressed wishes. Conversely, if you pass away without a valid will (intestate), the estate administration process may become more complicated, often leading to delay, uncertainty, and increased legal costs. In addition to the above, Wills and Estates includes drafting wills, resolving disputes, and ensuring compliance with tax and debt obligations.

property conveyancing

Property Law deals with the legal aspects of buying, selling, transferring and maintaining property. It ensures compliance with regulations, protects the interests of all parties, and addresses issues like sub-divisions, title disputes, zoning laws, and unpaid liabilities during property transactions. Instructing a solicitor to manage your conveyancing transaction can provide a higher level of protection against potential legal disputes. A solicitor ensures that all aspects of the transaction are handled appropriately. This includes conducting and reviewing property searches and title investigations to identify and mitigate the risk of hidden issues that may otherwise arise post-settlement.

Insurance

Insurance law encompasses matters such as motor vehicle accidents and public liability matters. Motor vehicle accident claims are managed through the Compulsory Third Party (CTP) insurance scheme, covering injured road users, including drivers, passengers, pedestrians, and cyclists. Key steps include notifying the police, identifying the at-fault vehicle's insurer, and lodging a claim within specific timeframes. Compensation may cover medical expenses, lost earnings, non-economic lost (pain and suffering) and related costs. Processes and entitlements vary by state, so consulting legal or insurance professionals is recommended for guidance. If you have been injured in a public place or on someone else’s property due to unsafe conditions, you may be entitled to compensation through a public liability claim. Property owners must maintain safe premises, and their negligence—such as slippery floors in supermarkets or unsafe walkways—may entitle you to damages. Compensation can cover pain and suffering, lost income, medical expenses, and care costs.

Laptop and Paperwork

Early access of Super Under superannuation policies, access to your superannuation savings is generally preserved until you reach your retirement age. However, there are limited and specific circumstances in which early release may be permitted. These include situations involving severe financial hardship, compassionate grounds, permanent or temporary incapacity, terminal illness, low account balances, and the first home super saver scheme. The most common grounds on which individuals seek early access to their super include Total and Permanent Disability (TPD) and  Income Protection. TPD included in superannuation fund policies, provides a lump sum payment if illness or injury prevents you from working in your prior occupations. Income protection insurance, sometimes referred to as income support insurance, is a financial safety net that offers support to individuals who are unable to earn an income due to illness, injury, or disability.
